We, UNIKUM.LV, value our clients and the data entrusted to us when shopping online. We care about the security of both our products and the purchasing process. Please read this privacy policy about how and for what purposes our Clients’ data is processed. The terms used in the Privacy Policy are explained in the Terms and Conditions, unless otherwise stated. Please note that some sections of the Privacy Policy may not apply to the specific Service received by the Client.
WHAT PERSONAL DATA DOES UNIKUM.LV PROCESS? UNIKUM.LV mainly processes two types of personal data – data necessary to create a Profile and data required for the execution of the Contract (account information). We process personal data provided by the Client through various online or offline sources, including when the Client uses our Website or Application, contacts us, uses social media, participates in loyalty programs, and in other ways. Personal data required to create and maintain a Profile includes data in the Profile, such as the Client’s name, contact information, information about saved Products, and the Client’s interests. Personal data necessary for the conclusion and execution of the Contract includes data in the Contract and Invoice, such as name, surname, contact information, payment information, Contract data (purchased Goods, their quantity, price, and purchase time), as well as communication between the Client and UNIKUM.LV regarding the Order.
WHERE AND HOW DOES UNIKUM.LV USE PERSONAL DATA? This section of the Privacy Policy describes the purposes of processing the Client’s Personal Data and provides other information about such processing.
USE OF COOKIES On the Website, we use cookies that process technical data, including the address of the internet server used by the Client, domain name, browser used, IP address, chosen settings, and actions performed on the Website or in the Application to provide services and maintain the Website and Application. Cookies are small text files that a web browser (such as Internet Explorer, Google Chrome, Firefox, or Safari) saves on the Client’s computer or mobile phone. A cookie does not contain direct personal information about the Client and cannot be used to directly identify individual users, but it can provide information about the Client’s habits and preferences. Cookies can be considered as a way for a website to retain memory, allowing it to recognize the user and respond accordingly. Most browsers can indicate that the client does not want to receive cookies at all or only from a specific website. All modern browsers allow changing cookie receipt settings. These settings are usually available in the browser preferences or settings menu. We use Google Analytics services. Clients can opt out of its use by downloading and installing the Google Analytics opt-out browser add-on. USE OF PERSONAL DATA FOR PROVIDING SERVICES
CONCLUSION AND EXECUTION OF THE CONTRACT To provide the Service by concluding and executing the Contract with the Client, we process the personal data necessary for the conclusion and execution of the Contract, including information needed to resolve any problems that may arise during the execution of the Contract. The basis for processing personal data is the conclusion and execution of the Contract and the protection of the interests and rights of both parties (Client and UNIKUM.LV) in case of disputes, as well as ensuring the fulfillment of commercial and accounting obligations. If the Client does not provide their personal data when its processing is required for the conclusion and execution of the Contract or under the law, we cannot provide the Services.
CREATION AND MAINTENANCE OF PROFILE To create and maintain the Client’s profile on the website, which is used as a communication channel for service provision and delivery, we process the necessary Personal Data for this purpose, including Products saved by the Client and indicated interests. When creating a Profile, only the information necessary to create the Profile, submit the Order, and conclude the Contract should be provided. The basis for processing personal data is the conclusion and execution of the Contract and the protection of the interests and rights of both parties in case of disputes. Profile data serves as confirmation of the Client’s actions. Non-binding information is processed based on the Client’s consent, which may be withdrawn at any time, including by deleting such information from the profile.
USE OF PERSONAL DATA FOR MARKETING PURPOSES We may send the Client marketing communications containing information about our promotions, news, and other information not related to the execution of the Contract and the provision of Services via email, based on the Client’s consent, which may be withdrawn at any time. When preparing marketing messages, we use profiling to prepare the most appropriate offer for the Client, based on data about the Services previously used and/or Products purchased. We process the Client’s Personal Data until the Client withdraws their consent to receive marketing materials or until there is no longer a need to retain proof of the received consent. If the Client withdraws their consent, we will no longer send them messages, but we may retain proof that the Client gave such consent. Withdrawing consent to receive marketing messages does not affect the consent to process information received via cookies.
WHAT DATA CAN UNIKUM.LV TRANSFER TO THIRD PARTIES? Any information disclosed to us by the Data Subject is not available to Third Parties unless such disclosure has a legal basis. We may transfer the Client’s Personal Data to Third Parties who provide, for example, postal, delivery, accounting, and IT services. In certain cases, we may be required to disclose the Client’s Personal Data to Competent Authorities in accordance with a justified request under the laws of the Republic of Estonia. For all purposes of Personal Data processing, the Client’s data is received and processed by UNIKUM.LV and our cooperation partners who, in addition to those mentioned above, provide communication, banking, legal, and other services. As stated above, UNIKUM.LV is obliged to disclose the Client’s personal data to Competent Authorities in cases prescribed by law. We emphasize that we do not transfer the Client’s Personal Data to government authorities or third parties without a valid legal basis. UNIKUM.LV ensures that Personal Data processors engaged in providing the Services meet security standards not lower than those established by us.
HOW LONG DOES UNIKUM.LV STORE PERSONAL DATA? All information related to the Client is stored as proof of the Client’s identity, the conclusion of the Contract, and the provision of Services until the Contract is fulfilled, the Personal Data is no longer necessary for providing the Services, and the data retention period prescribed by applicable laws has come into force. To preserve proof of the conclusion and execution of the Contract, we retain the Client’s Personal Data for at least three (3) years after the conclusion or termination of the Contract. We may retain certain Personal Data or information for a longer period to fulfill other legal obligations imposed by Competent Authorities or to enforce our rights. For accounting purposes, we retain Personal Data related to concluded Contracts and provided Services for at least five (5) years from the date of conclusion of the Contract or provision of the Service. Information about the Client’s consent to process Personal Data will be stored as proof for at least five (5) years from the date of withdrawal of consent in accordance with the Personal Data Processing Law.
WHERE AND HOW IS MY PERSONAL DATA STORED? We store Personal Data in the European Economic Area (EEA), which is considered a secure area that ensures a level of security that meets our standards. All information provided to us by the Client is securely stored on servers under our control. This information is encrypted and protected by technical measures that enhance data security. We ensure that access to the Client’s personal information is allowed only to those persons directly involved in the execution of the Contract or provision of Services, and only to the extent necessary for them to fulfill their duties. This is ensured by technical solutions, physical access rights, and appropriate training of our employees who implement relevant security measures.
WHAT ARE MY RIGHTS? We respect the Client’s rights to access, manage, correct, control, and delete personal data processed by UNIKUM.LV on behalf of the Client. UNIKUM.LV provides the Client the opportunity to correct individual Personal Data via the Website. In this way, the Client can correct and delete information contained in the Client’s Profile. If the Client does not wish to manually correct the Profile or wishes to correct, delete, or exercise other rights regarding Personal Data not related to the Profile, the Client may submit a request to us as described in this section. Once we receive the Client’s request to exercise one of the rights below, we will review the request and provide a response without undue delay and, in any case, within one (1) month of receiving the request. The Client may exercise any of the following rights by submitting a request in one of the following ways: By sending a signed request with a secure electronic signature to [email protected]. We reserve the right to request additional information from the Client to verify their identity and protect the Client’s Personal Data from disclosure to unauthorized persons. The Client has the right to access their Personal Data free of charge. The Client has the right to receive information on whether we process their Personal Data, and if so, to request a copy of the Client’s Personal Data in our possession and information on how it is processed. The Client has the right to request that we correct inaccurate or misleading Personal Data. We provide the Client the opportunity to correct their Personal Data on our Website, although not all Personal Data can be corrected this way. We will verify the validity and accuracy of the corrected Personal Data. The Client has the right to request that we delete their Personal Data. However, we reserve the right to deny the deletion request if there is a legal and legitimate reason, for example, to fulfill certain legal obligations requiring processing, to establish, exercise, or defend legal claims, or for statistical purposes while taking appropriate technical and organizational security measures. The Client has the right to request that we restrict processing if there is a legitimate reason. In the case of restriction, UNIKUM.LV will process the Client’s Personal Data only with the Client’s consent, to establish, exercise, or defend legal claims, to protect the rights of another natural or legal person, or in connection with important interests of UNIKUM.LV. This does not apply to data storage. The Client has the right to object to the processing of Personal Data related to direct marketing or processing based on our legitimate interests, if, considering the particular situation and important grounds, the Client wishes to object to such processing. The Client has the right to request that we accept and transmit their Personal Data to the Client or to another data controller. This applies if the Client has provided the data based on consent or a Contract, and processing is carried out by automated means. These rights also apply, for example, to activity history and website usage history data. However, this does not apply to data created by us, such as customer profiles generated through data analysis. The Client has the right to withdraw previously given consent at any time. However, this does not affect the lawfulness of processing carried out before the withdrawal. These rights also apply to receiving marketing communications from us. If there are uncertainties regarding the processing of the Client’s Personal Data, the Client may contact us, and we will try to respond or resolve the issue. However, if the Client believes that we cannot resolve the issue, the Client has the right to file a complaint with the national data protection authority regarding UNIKUM.LV’s data processing activities. WHAT RIGHTS DOES UNIKUM.LV HAVE REGARDING THE PRIVACY POLICY? We may make changes to the Privacy Policy at any time by publishing them on the Website. Any version of the Privacy Policy published on the Website replaces all previous versions and takes effect immediately upon publication.
