We, UNIKUM.LV, highly appreciate our customers and the data entrusted to us when shopping at the online store.

We care about both the safety of our products and the security of the buying process. We invite you to read this Privacy Policy, how and for what purposes our Customer Data is processed.

Terms used in the Privacy Policy are explained in the Terms unless otherwise stated. Please note that some sections of the Privacy Policy may not apply to the specific Service that Customer receives.


WHAT PERSONAL DATA DOES UNIKUM.LV PROCESS?
UNIKUM.LV processes mainly two types of Personal Data – data required to create a Profile, and data required to execute the Agreement (account information). We process Personal Data that the Customer provides to us through various online or offline sources, including when the Customer uses the Site or the Application we have created, communicates with us, uses social media, participates in loyalty programs and in other ways.

The Personal Information required to create and maintain a Profile is the Personal Information included in the Profile and may be, for example, the Customer’s name, contact information, information about the Customer’s saved Products, and the Customer’s interests.

Personal data necessary for the conclusion and performance of the Agreement is Personal data included in the Agreement and the Invoice, and it may be, for example, the name, surname, contact information, payment information, data of the Agreement (purchased Goods, their quantity, price and purchase time), as well as communication between the Customer and UNIKUM.LV in connection with the Order.

WHERE AND HOW DOES UNIKUM.LV USE PERSONAL DATA?
This section of the Privacy Policy describes the purposes of processing the Customer’s Personal Data and provides other information related to its processing.

USING cookies

We use cookies on the Website that process technical data, including the Internet server address used by the Client, domain name, browser used, IP address, selected settings, actions performed on the Website or in the Application, for the purpose of providing services and maintaining the Website and the Application.

Cookies are small text files that a web browser (such as Internet Explorer, Google Chrome, Firefox or Safari) stores on the Client’s computer or cell phone. The cookie does not directly contain personal information about the Customer and cannot be used to directly identify individual users, but may provide information about the Customer’s habits and preferences. Cookies can be thought of as a way for a website to get a memory that allows it to recognize the user and respond accordingly.

Most browsers can specify that the Client does not want to receive cookies at all or only from a certain website. All modern browsers allow you to change your cookie settings. These settings are usually available in your browser’s preferences or settings menu.

We use Google Analytics services. The customer can opt out by downloading and installing the Google Analytics Opt-out browser add-on.

USE OF PERSONAL DATA TO PROVIDE THE SERVICE

CONCLUSION AND EXECUTION OF THE CONTRACT

In order to provide the Service, as part of the conclusion and execution of the Agreement with the Client, we process Personal Data necessary for the conclusion and execution of the Agreement, including information necessary to solve any problems that may arise during the execution of the agreement.

Processing of personal data is based on conclusion and execution of the Agreement and observance of protection of interests and rights of both parties (the Customer and UNIKUM.LV) when disputes arise, as well as to ensure performance of commercial and accounting obligations.

If the Customer fails to provide its Personal Data when its processing is necessary for the conclusion and execution of the Contract or in accordance with the law, we cannot provide the Services.

CREATING AND MAINTAINING A PROFILE

In order to create and maintain a Customer Profile on the Site, which is used as a communication channel for the provision and delivery of the Services, we process the Personal Data necessary for this purpose, including the Customer’s saved products and specified interests. When creating a Profile, only the information necessary to create a Profile, place an Order and conclude the Agreement must be provided.

Processing of personal data is based on the conclusion and execution of the Agreement and protection of interests and rights of both parties (the Customer and UNIKUM.LV) when disputes arise. The profile data serve as confirmation of the Customer’s actions. Processing of information, the provision of which is not mandatory, is carried out on the basis of the Customer’s consent, which can be withdrawn at any time, including by deleting such information from the Profile.


USE OF PERSONAL DATA FOR MARKETING PURPOSES

We may send to the Customer marketing messages containing information about our promotions, news and other information not related to the execution of the Agreement and provision of the Services by e-mail on the basis of the Customer’s consent, which may be withdrawn at any time.

When preparing marketing communications, we use profiling to prepare the most appropriate offer for the Customer based on Service data, namely, which of our Services the Customer has used before and/or which Products the Customer has purchased.

We process the Customer’s Personal Data until the Customer withdraws its consent to receive marketing materials or until it is no longer necessary to retain evidence of the consent received. If a Customer withdraws consent, we will no longer send the Customer a notice, but we may retain evidence that the Customer gave such consent.

Withdrawing consent to receive marketing messages does not affect consent to the processing of information obtained through cookies.


WHAT DATA CAN UNIKUM.LV PROVIDE TO THIRD PARTIES?
Any information disclosed to us by the Employer is not available to Third Parties unless there is a legitimate reason for such disclosure. We may transfer Customer Personal Information to Third Parties who provide, for example, postal, delivery, accounting and IT services. In some cases, we may be obliged to disclose the Customer’s Personal Data to the Competent Authorities in accordance with a reasonable request regulated by the legislation of the Republic of Latvia.

For all purposes of processing the Personal Data of the Customer, the Personal Data of the Customer is received and processed by UNIKUM.LV and our cooperation partners, which, in addition to the above, provide communication, banking, legal and other services. As stated above, UNIKUM.LV is obliged to disclose the Customer’s Personal Data to the Competent Authorities in cases specified in the legislation.

We would like to emphasize that we do not transfer the Customer’s Personal Data to state authorities or third parties without an appropriate legal basis. UNIKUM.LV ensures that the processors of the Customer’s Personal Data whom UNIKUM.LV engages to provide the Services meet the security standards not lower than the security standards set by us.

HOW LONG DOES UNIKUM.LV KEEP PERSONAL DATA?
All information relating to the Customer is retained as confirmation of the Customer’s identity, conclusion of the Agreement, provision of the Services, and is stored until the Agreement is fulfilled, the Personal Data is no longer needed to provide the Services, and the retention period of Personal Data specified in the legislation applicable to UNIKUM.LV comes into force.

In order to preserve evidence of the execution and performance of the Agreement, we will retain the Customer’s Personal Information for at least three (3) years from the date of execution or termination of the Agreement. We may retain certain Personal Information or information for a longer period of time in order to comply with other legal obligations imposed on us by Competent Authorities or to exercise our rights.

For accounting purposes, we shall retain the Customer’s Personal Data related to the executed and performed Contracts and Services for at least five (5) years from the date of execution of the Contract or provision of the Service.

We shall retain information on the consent given by the Customer to the processing of Personal Data as evidence for at least five (5) years from the date of withdrawal of consent in accordance with the Personal Data Processing Law.

WHERE AND HOW IS MY PERSONAL DATA STORED?
We store Personal Data in the European Economic Area (EEA), which is considered a secure location and provides a level of security that meets our standards. All information provided to us by the Client is securely stored on our or our controlled servers. This information is encrypted and protected by technical means, which increases data security.

We guarantee that access to the Customer’s personal information is allowed only to those persons who are directly related to the execution of the Agreement or the provision of the Services, and to the extent necessary for the said person to perform his duties. This is ensured by technical solutions and physical access rights, as well as proper training and education of our employees, who take appropriate security measures.

WHAT ARE MY RIGHTS?
We respect the Customer’s right to access, manage, correct, control and delete Personal Data that UNIKUM.LV processes for the Customer. UNIKUM.LV gives the Client the opportunity to correct individual Personal Data using the Site. Thus, the Client can correct and delete the information contained in the Client Profile. If the Customer does not wish to manually correct the Profile or wishes to correct, delete or exercise other rights with respect to Personal Information unrelated to the Profile, the Customer may submit a request to us as described in this paragraph.

When we receive the Client’s request to exercise any of the rights mentioned below, we will review the Client’s request and provide a response without undue delay and in any event within one (1) month of receipt of the request.

If the Customer wishes to exercise any of the rights set forth below, you may do so by submitting a request in one of the following ways:

We reserve the right to request additional information from the Client to verify the identity of the person and protect the Client’s Personal Data from disclosure to unauthorized parties. The Customer has the right of free access to his Personal Data.

The Customer has the right to be informed whether or not we process the Customer’s Personal Data and, if we do, to request a copy of the Customer’s Personal Data that we keep, as well as information on how the data is processed.

The Customer has the right to request that we correct inaccurate or misleading Personal Data of the Customer. We provide the Customer with the opportunity to correct their Personal Information on our Website, but not all Personal Information can be corrected using this method. We will verify the validity and accuracy of the corrected Personal Information.

The Customer has the right to request that we delete the Customer’s Personal Data, but we reserve the right to indicate a request to delete Personal Data if there is a legitimate and legal reason to do so, such as to comply with certain legal obligations that require processing to establish, implement or protect legal requirements or for statistical purposes by taking appropriate technical and organizational security measures.

The customer has the right to request that we restrict processing if there is a legitimate reason to do so. In case of restriction on processing of the Personal Data of the Customer, UNIKUM.LV processes the Personal Data of the Customer only after obtaining the consent of the Customer, either to assert, implement or defend legal claims, or to protect the rights of another natural or legal person, or in connection with important interests of UNIKUM.LV. This does not apply to the storage of Personal Data.

The Customer has the right to object to the processing of Personal Data in connection with direct marketing or processing on the basis of our legitimate interest, but taking into account the specific situation and important reasons, the Customer wishes to object to such processing in connection with the said specific situation or important reason.

The Customer has the right to request that we accept and send the Customer’s Personal Data to the Customer or another data controller. The Client may exercise this right because the Client has provided the data on the basis of the Consent or Agreement, and the processing is carried out using automatic means. This right also extends, for example, to activity history and website usage history data. However, this does not apply to the data we create, such as customer profiles created through data analysis.
The customer has the right to withdraw previously given consent at any time. However, this does not affect the legitimacy of processing performed before the Client withdrew his or her consent. This right extends to receiving marketing messages from us.

If there are any ambiguities related to the processing of the Customer’s Personal Data, the Customer may contact us and we will try to provide an answer or find a solution to the problem. However, if the Customer is convinced that we cannot find a solution, the Customer has the right to complain to the national data protection authority for individuals about the data processing activities carried out by UNIKUM.LV.

WHAT ARE UNIKUM.LV’S RIGHTS REGARDING ITS PRIVACY POLICY?
We may make changes to the Privacy Policy at any time by posting them on the Site. Any version of the Privacy Policy posted on the Site supersedes all previous versions of the Privacy Policy and becomes effective as soon as it is posted on the Site.
